Canada’s most popular erectile dysfunction medication Viagra has been approved by the Federal Court for its safety and efficacy.
The Federal Court has upheld an appeal from the Canadian drug company Pfizer in a suit that seeks approval for Viagra, the first erectile dysfunction medication ever.
The Federal Court ruled in favour of the company on claims of erectile dysfunction, including “unnecessary and dangerous” use of the drug.
Pfizer also challenged the approval of the drug by the Canadian Patent Office in 2011.
A court decision in its favor was also upheld in a case that the Food and Drug Administration recently announced a recall of Viagra.
Pfizer’s Viagra, manufactured by Pfizer, is a popular erectile dysfunction drug that contains sildenafil citrate as its active ingredient. The active ingredient in Viagra, sildenafil citrate, is a phosphodiesterase type 5 (PDE5) inhibitor.
In a complaint filed in the Federal Court in 2009, the company alleged that Pfizer’s drug “has failed to meet the requirements of the Food and Drug Administration and is potentially harmful to the patient’s health.”
Pfizer argued that the product’s safety has been undermined by a finding that it posed an unreasonable risk, namely that “the product has a potential for misuse or abuse, and there is a possibility that the patient may misuse the drug or consume alcohol while using it.”
In its appeal in the Federal Court, the company agreed that the product posed a risk of misuse and abused its marketing exclusivity for sildenafil citrate.
In April 2010, the Federal Court upheld the validity of the “potentially unsafe use” drug in a case where it had invalidated a patent for sildenafil citrate.
The Federal Court in Canadian patent law allows for “[i]f the patent is invalid for failure to give effect to the intent of the Legislature or the obviousness of the invention” but not for obviousness.
However, in its appeal in the Federal Court, the company argued that it was entitled to seek judicial review of the Federal Court’s decision in favour of Pfizer and that the case should also be transferred to the Federal Court for a determination of the validity of the patent.
The Federal Court found that Pfizer had shown a demonstrated lack of inventive done by the company over the years, in that it did not have to show that Viagra was not a safe drug for use in men with erectile dysfunction. This was “an obvious invention” as the Federal Court found it was not.
Pfizer argued that the “potentially unsafe use” drug was “a non-obvious matter” and thus that the Federal Court was “unable to discern whether a reasonable person would consider such an approach.”
The Federal Court agreed that Pfizer’s argument was “far from obvious” and thus that the court did not have to resolve the matter in order to find that Viagra was not a safe drug for use.
The Federal Court further found that the product’s risks were “obvious” and thus “a reasonable person would consider the drug’s potential for misuse and abuse.”
Pfizer argued that it was entitled to a determination of the validity of the patent.
The Federal Court dismissed the claim of “unnecessary and dangerous use” of Viagra by Pfizer. The Federal Court noted that Pfizer had provided the court with “no evidence” that the drug would be “unnecessary and dangerous for patients or health care providers.”
The Federal Court also found that the “potentially unsafe use” drug was a non-obvious matter, but “would not be an obvious invention.”
The Federal Court rejected Pfizer’s argument that it had established its ability to seek judicial review of the Federal Court’s decision in favour of the company and that the case was transferred to the Federal Court for a determination of the validity of the patent.
Pfizer has appealed from the Federal Court’s decision, and it will appeal to the Federal Court of Appeal in the future.
